ARGUMENTS ON BEHALF OF RTI APPLICANT with reference to First Appeal hearing
vide No.:79/AA/RTI/DHC/47/2016 Dated May 7, 2016

Respected Sir,
I humbly request
your esteemed authority to kindly take into consideration all the
below written arguments & documents & CD while disposing off this
appeal as each of these points are legally & technically necessary to be
taken into consideration in the interest of justice & fair play:-
(a)
All submissions by undersigned in
first appeal.
(b)
The concerned RTI (annexed for your
kind perusal).
(c)
The Corresponding letter & ten
enclosures on the basis of which this RTI was filed (annexed for your kind
perusal)
(d)
That Identity fraud is a synonym of
unlawful identity change.
(e)
An additional photo identity document
dated 29/10/2016 of Ms. PATIVRATA DEVI (annexed for your kind
perusal) who played fraud by misrepresentation/ concealment of her true legal
identity and filed complaint using an illegal name JHOOTHI DEVI R/o AZ-747, Rani
Bagh, New Delhi – 110034 before Dwarka courts (mentioned below), hence this
qualifies as an “Identity Fraud”
(f)
That the undersigned filed perjury
application (with five annexure) on 29.04.2016 before the Hon’ble Dwarka Courts
of Ld MM Ms. Joshila Devi Surtalwala case no. CC No.16/4/16 (annexed for your
kind perusal).
(g)
That the undersigned shortly
thereafter requested the Hon’ble Rohini Courts of Ld MM Ms. Joshila Devi
Surtalwala case no. CC No.16/4/16 to kindly decide this perjury application
first in the interest of justice (annexed for your kind perusal).
(h)
That this Hon’ble Rohini Courts of
Ld. MM Ms. Joshila Devi Surtalwala case no. CC No.16/4/16 ordered dated 05.05.2016
(annexed for your kind perusal) ordered the petitioner to file reply to
abovesaid perjury application alongwith affidavit qua financial status but the
petitioner is playing clever hide & seek game before the concerned Hon’ble
Rohini Courts of Ld MM Ms. Joshila Devi Surtalwala case no. CC No.16/4/16
(being supported by concerned Ld MM) as follows:- è On subsequent
working date 22/07/2016 the petitioner sent her mother with a copy of affidavit
qua financial status & cleverly did not bothered to send her reply to
perjury application (despite she being backed by a top law firm of the country
as per her petition) & undersigned orally requested the concerned Ld MM to
pass a NO SAY ORDER against the petitioner vis-à-vis above
mentioned perjury application but the Ld MM neither accepted this oral request
nor mentioned reasons thereof on the order sheet dated 16/03/2016 (annexed for
your kind perusal). This Hon’ble FAA is requested to summon the audio/video
recordings dated 16/03/2016 from the concerned court to arrive at the truth.
(i)
That till date undersigned was never
provided with “Pamphlet of Mediation” which is mandatory as per law to be sent
alongwith the copy of petition under the domestic violence act but despite requests
by the undersigned before concerned Hon’ble Rohini Courts of Ld MM Ms. Joshila
Devi Surtalwala case no. CC No.16/4/16, his requests were turned down with
warnings with dire consequences. Hence, neither legally & nor technically
the concerned Hon’ble Court ever gave the undersigned an opportunity for
mediation which is against the law for the time being in force in India.

LATEST PERJURY
(COURT RECORD TAMPERING):- I am working on these arguments right now
at around 4 am on 06/05/2016 midnight & just now I am checking the hefty
around 930 pages Certified Copies (ENTIRE FILE FOR RECORD) obtained by me in April,
2016. To my utmost shock these five annexure to the perjury application
(discussed in point (f) above) whose Certified Copy I obtained in February, 2016
(discussed in point (f) above & annexed within these arguments for your
kind perusal) are found to be missing in the Certified Copy I received in April,
2016. This is utmost shocking vis-à-vis latest court record tampering I
noticed just now.
(k)
That if any person/ authority
connives with anyone who plays fraud/ misrepresentation/ concealment of true
identity then such person/s are also liable for punishment under various laws
for the time being in force in India.
(l)
That if any FIR / Legal Action is
initiated against any person/s by your esteemed institution based on
information provided then I shall be provided a copy of that & all related
communications, noting sheets, marking sheets also may kindly be provided to me
alongwith decision of FAA if & as this Hon’ble FAA deems fit.

NOTE:- annexure 17 to annexure 21 in
point (4) above proofs latest court record tampering because the certified copy
of annexure 17 to 21 which I have ANNEXED IN POINT (4) ABOVE had been obtained
by me in February, 2016 whereas just now at around 4am on 05/05/2016 I am
checking another certified copy (ENTIRE FILE) obtained by me in April, 2016
& surprisingly & shockingly these five annexure have been removed from
the latest records. This is LATEST COURT RECORD TAMPERING. This is called
perjury on perjury. This can also be termed as court record tampering on
court record tampering. This can also be called as fraud on court to
cover up another fraud on court. This also proves the judicial/ bureaucratic/
other/ high level influence being used to tamper with the records within the
Hon’ble Court of Ld Metropolitan Magistrate Ms. Joshila Devi Surtalwala case
no. CC No.16/4/16 Room No. 109, Dwarka Courts Complex.

Annexure CD = 1 Computer CD è
respected sir, I am also annexing a computer CD wherein I am attaching three
files as follows:-
(a)
DVC 012 [10.4.16] named file in
computer CD contains the certified copy of entire file obtained by me in February,
2016 (alongwith other case files as I got them scanned together). Page number
138 to 142 of this file (last edited on 23/04/2016 1:54pm) contain those five
annexure which were found to be missing from the entire certified copy which I
obtained in April, 2016 vis-à-vis below files named DVC 021
(b)
DVC 024 named file in computer CD is the certified
copy of entire file obtained in April, 2016 (4 pages were missing in scan due
to machine error while scanning) so those missing 4 pages I got scanned through
next file below. This file name DVC 021 contains 666 pages.
DVC 032 named file contains those 4 missing pages which
the scanning machine missed while scanning all 670 pages at one go.
